SB2801 - Renters Security Deposits

California Assembly Bill 2801, also known as the Tenancy: Security Deposits bill, is a set of new laws that aims to ensure security deposits are used fairly and to protect renters. This bill goes into effect July 1, 2025.

  • Photographic requirements: Landlords must take photos of the unit before the tenancy begins, after the tenant moves out, and before and after any repairs or cleaning. These photos must be provided to the tenant along with the security deposit disposition form.
  • Itemized statements: Landlords must provide tenants with an itemized statement that explains the cost of any allowable repairs or cleanings.
  • Security deposit deductions: Landlords cannot deduct costs for professional cleaning services, materials, or contractor work from a tenant's security deposit unless it's reasonably necessary to restore the unit to its original condition.
  • Bad faith: Landlords cannot make claims against the tenant or security deposit if they fail to comply with the itemized statement requirements in bad faith.
SB2747 - Consumer's Credit Reporting

Assembly Bill 2747, requires a landlord of an assisted housing development to offer tenants obligated on the lease of units in the development the option of having their rental payments reported to at least one consumer reporting agency, as specified.

  • Leases after April 1, 2025: The bill would require, for leases entered into on and after April 1, 2025, the offer of positive rental payment information reporting to be made at the time of the lease agreement and at least once annually thereafter, and for leases outstanding as of January 1, 2025, the offer of positive rental payment information reporting to be made no later than April 1, 2025, and at least once annually thereafter.
  • Tenant Rights: Tenants have the right to request, and would require a landlord to provide, additional copies of the written election of positive rental payment information reporting at any time.
  • Landlord charges: The bill would authorize a landlord to charge a tenant that elects to have positive rental payment information reported the lesser of $10 per month or the actual cost to the landlord to provide the service, unless the landlord does not incur any actual cost to provide positive rental payment reporting. 
SB900 - Associations Responsible for Repairs

This bill would make an association responsible for repairs and replacements necessary to restore interrupted gas, heat, water, or electrical services that begin in the common area.

  • 14 Days to Repair: The bill would require an association’s board to commence the process to make those repairs within 14 days, as arranged.
  • Insufficient Funds: If there are insufficient funds in reserve to cover the cost of repairs, the bill would authorize an association to obtain competitive financing to commence repairs or replacements without a vote and to levy an emergency assessment to repay the loan if certain conditions are met.
  • Repair actions extend beyond 14 days: If the board is unable to reach a quorum during the 14-day period, the bill would authorize a limited reduced meeting, only for the vote to commence the process to make repairs. The bill would also authorize directors of an association to vote by electronic means for the purpose of initiating repairs or replacements pursuant to the bill’s provisions.
